Rules, Regulations and Park Policies 2007 - 2008

The following rules, regulations and park policies are for the protection of all of the guests/residents of Bonita Mesa RV Resort L.L.C. ("Bonita Mesa" or the "Park"), and for making the park a pleasant and safe environment for all of Bonita Mesa's guests/residents; the terms "guests" and "residents" are considered by Bonita Mesa to be synonymous. The rules are for everyone. We are all living in close proximity to our neighbors and we need to follow some basic rules of consideration.  Many of these rules have previously been implied and are now formalized.  
All of our indoor facilities are non-smoking. Smoking areas have been set-up in areas outside the indoor facilities. Please put all ashes and cigarette butts into the receptacles designated for them.
The Management of Bonita Mesa has final approval of all Recreational Vehicles (seasonal or annual) moving into our park.  Management also has the right to request an RV occupying an annual site to be moved out of the park if sold.  

SPECIAL RULES:  
Special rules relating to the clubhouse, laundry room and all other common areas will also be posted in these locations.  The special rules constitute a part of these rules and regulations, and violations of the posted rules will be treated as a violation of these rules and regulations.  
The management reserves the right to revise, eliminate, modify or add rules at any time.  All such changes or additions will be posted on the bulletin board in the clubhouse and any such changes or additions will take precedence over the printed rules.


I.   REGISTRATION AND PARKING PROCEDURES
01.   Seasonal residents need to stop by the office and register when they enter the park with their RV.
02.   Seasonal residents (dailies, weeklies, monthlies, multi-monthlies, and non-permanent annuals) must have a park staff member present when parking their RV, to ensure the proper placement of their RV, and to ensure no park property is damaged. No exceptions. Seasonal residents are also solely responsible for the parking of their RV, even if assisted by a park staff member. The park assumes no  responsibility whatsoever for the ability of a seasonal resident to park their RV's without causing any damage to park property or their vehicle. 
   a.  RV's must be parked even with the rear of the concrete patios.  
   b.  RV's are not to be moved backward or forward once a staff member places you on a site.  
03.   Park Model unit residents must notify the park within 24 hours of entering the park.
04.   The speed limit in the park is 10 miles per hour and will be strictly enforced.  
05.   The word "Resident" shall apply only to the listed occupant(s) actually occupying the unit whether they be relatives or renters.
06.   The resident occupying each unit has the privileges of the facility, resident activities, etc.
07.   Any RV leaving the park must be re-parked, with the assistance of a park staff member, upon its return to the park, in accordance with all other requirements in this section.
II.  RENTS AND BILLS DUE
01.   Seasonal rents (ie: daily, weekly, monthly and multi-monthly) are due in full at the time of check in (minus any deposits previously made).  
02.   Seasonal rents not paid at the time of check in will be charged the daily rate until paid.
03.   Annual rents are due January 1st and are delinquent after January 10th.  After January 10th the daily rate will be charged from the first until such time as the bill is paid in full and eviction proceedings may commence at the option of the park. Delinquent guests will be responsible for all charges associated with eviction and collection proceedings.
04.   Checks returned from the bank for any reason are subject to a service charge of $25.00.  
III.   GUESTS
01.   Spaces are rented with a maximum occupancy of two persons occupying a unit.
   a.  Guests are welcome but all residents (annual and seasonal) must register them in the office and pay a visitor charge of $5.00 per day per guest upon their arrival.
   b.   Any guest under the age of 18 may use the facilities when accompanied by an adult resident.
   c.  All guests are subject to obeying all park rules and regulations.
   d.  The park reserves the right to limit the number of guests and their length of stay.
IV.  PARK MODELS WITH RV'S
01.   Annuals with RV's can park on their site for three days to load and unload only, then they will need to be removed from the site (county regulations state only one RV is permitted per site, Park Models are RV's). Please do not abuse this. After three days, park models with RV's, parking their RV's on another site, or anywhere prohibited in the park's rules, regulations or policies, will be charged the daily rate, then in effect, for parking their RV longer than the loading grace period, previously described.
02.   If you cannot park your RV on your site we will attempt to find an empty space to use rent free for three days (except for the January thru March busy season). 
   a.  After three days you will be charged the daily rate.
   b.  January thru March you will be charged the daily rate from the first day.
V.  NOISE AND AIR POLLUTION
01.   Quiet time in the park is from 10:00 pm to 8:00 am.
02.   No excessive warming up of gasoline or diesel engines at your sites, as they may cause excessive fumes.
03.   Please be considerate of your neighbor and pull your automobile in your driveway front-end first. This keeps the muffler noise away from your neighbor as well as any fumes from your exhaust.  

VI.  INDIVIDUAL SITES

01.   Utilities such as electricity, sewer, water and phones are run to the individual sites and the park is responsible to the hookup point.
   a.  From the hookup point (pedestal) to and throughout the RV unit is the resident's responsibility.
02.   Every site is to be kept clean and there is to be no laundry hung from an RV or the trees.
   a.  Swimming suits and towels can be hung after swimming to dry only.
03.   Washers are not allowed on your space, RV, or in any building thereon.
04.   Water softener units are not allowed in park models.  
05.   There are to be no boxes or other storage under, behind or around your unit.
06.   Do not walk thru other resident's  spaces between rigs and park models.
07.   Fire regulations state no automobiles are to be parked in the street at night.  If you have more than one vehicle, they both have to be parked in your space off the road.  
08.   No auto repair work or oil changing are permitted in the park.
09.   "No washing" of Park Models, RV's or vehicles of any type is permitted in the park using park provided water. Guests may contract directly with an outside company  using non-toxic, environmentally friendly products only, as well as their own water supply.
   a.  Additionally, all guests should ensure any outside companies they contract with have at least $1 million dollars of liability and worker's compensation insurance. 
   b.  Guest must request, obtain and verify the insurance from vendors. Naming the guest and Bonita Mesa RV Resort L.L.C. as additional insured parties under the related vendors insurance policies before scheduling the washing of their vehicle.
   d.  These insurance requirements apply to all other individual site improvements initiated by all guests/residents of the park as well. All guests/residents not complying with these requirements agree to personally assume all responsibility for any and all liabilities resulting from any matters contracted with outside vendors relating to their sites.
10.   All seasonal and annual tenants are responsible for weed control on their space.
   a.  In the event these spaces are not kept clear of weeds and debris and after notice to the tenant, management may perform the required maintenance and charge the resident for the work performed.
11.   Large trash bins as well as aluminum can recycle containers are located throughout the park.
   a.  Please tie all trash in plastic bags and crush boxes and other large items.  
   b.  No type of liquid is to be placed in the dumpsters including motor oil.  It is against the law and fines will be levied.

  VII.  POOL

01.  Winter pool hours are from 9:00 am to 10:00 pm, summer hours are from 8:00 am to 9:00 pm.
02.  Do not go in the pool after using suntan oil or lotions. Please be considerate and shower off all oil or lotions prior to entering the pool or spa.
03.  No pool shoes of any kind are acceptable, they leave marks on the bottom of the pool.
04.  No children in the pool under 16, except during the following times: 11:00 am to 1:00 pm and 5:00 pm to 7:00 pm. 
05.  Children need to be supervised by an adult at all times.  
06.  No Children under 16 are allowed in the spa at any time.

VIII  PETS   (DOGS AND CATS)........**

01.    All pets must be approved by the management.  No more than two pets per site are permitted.
02.    All pets must be kept in the pet areas only.
   a.   When outside, pets must be contained in pens, or on a leash and not be allowed  to continually bark.
   b.   Please consider your neighbor.  If your pet barks when left behind in your rig,  take them with you and consider buying a bark collar, they really work.  If they continue barking you can be required to vacate your space.
03.    All pets must be walked on a leash.  Please limit the leash length to 6 feet.
04.    You MUST clean up after your pet anywhere in the park, including your own site.
   a.    Please clean up in the desert, other people walk out there too.
05.    Do not allow your pet to "litter" in someone else's site.
06.    Pets are off limits within the grassy areas, cactus gardens, front office and recreation hall areas.   Exceptions are a Seeing Eye or hearing dog.  

IX.  PARK PHONES

01.   The park has its own private phone system, no outside Qwest lines are permitted.
02.   The hook-up charge is $40.
03.   The monthly rate is $25.00 paid in advance.
04.   800 #'s have an access fee of $.25 for each call.
05.   Our long distance rates for the U.S., Canada and Mexico are $.15 per minute.
06.   For the first 2500 minutes. (each month) applicable to each phone line, only long distance charges will be assessed  (i.e.: no local charges). 
   a.  All minutes incurred in excess of 2500 minutes will be charged at an additional $.10 per minute. 
07.   The phone bills are run on the 22nd of each month and are payable within ten days. A $25.00 late fee will be charged for late payments.
08.   To save your phone number for the following year a $5.00 per month fee will be charged when you return to the park.
   a.  You must notify the office at departure if you wish to save your phone number.
   b.  Phone charges are prorated when you come in and when you leave.
09.   The phone system occasionally may not be usable due to technical difficulties caused by our system or the system of our providers.  We strongly recommend that any of our guests with health concerns buy a cellular phone or emergency pager in case our phone system is out of service. 

X.  SATELLITE DISHES

01.    Satellite dishes are acceptable in the park; however, they must be no larger than 24 inches in diameter.
02.    No more than two satellite dishes per site are permitted.  

XI.  ELECTRIC RATES

01.    The electric rates charged by the park are established based upon the rates charged by outside utility companies, considering the park's sole responsibility to repair and ultimately replace the park's related utility distribution infrastructure, and may change at any time.
02.    A $1.00 reading fee is applied at each billing.
03.    Your meter is read and billed on a periodic basis.
04.    A late fee of $25.00 will be charged for all late payments. (if you wish your electric and phone to be paid at the same time, advise the  office and  your electric read will be done closer to the phone bill date).  

XII.  FIREPLACES

01.    There will be no WOOD burning fireplaces or pits at any site.  Propane and charcoal are acceptable.  

 XIII. RESERVATIONS

01.    Reservations need to be made for the following year by March 1 by in park people.
02.    There is a three month minimum stay requirement for reservations for a moveable unit in most sites.
03.    There is a four month reservation requirement for a unit with slides or in the green area.  

XIV.  DEPOSITS AND CANCELLATIONS

01.    A $250.00 deposit is to be paid at the time you leave the park if you wish to reserve a space for the next season.
02.    Cancellations made before September 1 of new season will be returned minus a $35.00 administration fee.
03.    Deposits relating to any reservation cancellations made after September 1 of the new season, are non-refundable, for any reason whatsoever. 

XV.  REFUNDS  

01.    In the event you have to leave earlier than the date you paid through, you may request a refund.
02.    All refunds are based on the actual time spent in the park plus a $35 administration fee, both for seasonal and annual sites.  (ie: monthly, 3 mo, 4 mo etc.)
03.    Additional days stayed over the 3 month, 4 month etc. time frame will be charged at the daily rate.
04.    Refunds are not pro-rated.  
 XVI.  BLOCK WORK, IMPROVEMENTS TO SITES
01.    All improvements to all lots have to be approved in advance in writing.
   a.   Request a Form in the office, complete all information requested, sign and return to the office for approval.
   b.   If improvements require a permit from the County of Yuma, the permits must be applied for and approved.  A copy is to be in the office before work is started.  
   c.   Park Model units must have skirting installed within 30 days of move-in.
02.    No concrete is to be laid at any site.
03.    All block work must be pre-approved and is not to be removed from the site upon resident leaving.
04.    If blocks are laid over water lines, electrical or sewer lines, and they have to be pulled up to make repairs, the park will not be responsible to replace the blocks.
05.    Sheds need to be approved in writing by management before being placed on a site.
   a.   One shed no bigger than 8 x 8 will be allowed, if your site will accommodate it and it meets county regulations.
06.    Landscaping:
   a.   All landscaping must be approved by the management.
   b.   Desert plants only.
   c.   Please do not link a drip line or install a timer, into the parks water system. It may result in leaks.
   d.   Park tree trimming is to be done by Bonita Mesa Maintenance people only.
07.    Digging:
   a.   You must contact the office prior to any kind of digging for written permission. After permission to dig is granted, the office will advise you of the location of utilities on your site.
   b.   Residents who dig without prior approval do so at their own risk and are responsible to pay for the repair of damage to any utilities, and may be asked to leave the park.
08.    Permanent Units Removed
   a.   Upon removal a space needs to be returned to original rentable condition.
   b.   If not done so, the park will charge materials and labor to the space rental resident.  

XVII.  STORAGE

01.    If you wish to leave an RV or a shed on your site, you must pay the annual rent in advance.

XVIII.  CHANGING SITES

01.    In the event you have paid and checked into a site of your choice and you wish to move to another site, there will be a $25.00 charge for each move.  

 XIX.  REPAIR PROBLEMS

01.    If a difficulty arises with your sewer, phones, electrical etc. please call the office first.  The office staff will arrange for the appropriate repair services. Many of the repairs can be handled in park. The park is responsible for service to the pedestal only, whether it be electrical, phone, etc.
   a.   If you call a service person without going through the park office first, and the problem turns out to be park related, you will be responsible to pay for any charges to the repair person you contracted with.
02.    As the park is on a septic tank system caustic chemicals (Drano, acids etc) cannot be used in any drainage pipes within your RV. 
   a.   Do not flush Depends, tampons, etc down the toilets.
   b.   Do not put any type greasy materials down your kitchen sinks.

XX.  LAUNDRY HOURS

01.    The laundry room is open 24 hours a day except for cleaning times.
   a.   Use the keypad when the main building is closed.  
   b.   The laundry room is closed for cleaning in the winter every Tuesday and Thursday  from 6:30 to 9:00 am. DO NOT START YOUR LAUNDRY BEFORE 6:30 AM ON CLEANING DAYS. WAIT UNTIL AFTER THE LAUNDRY ROOM RE-OPENS.
   c.   Please use LIQUID phosphate free laundry soap.  (powdered soap hardens in the septic lines causing slow drains and plugged lines.)
   d.   Summer cleaning is on Tuesday only from 6:30 to 9:00 am.
   e.   The park does not furnish irons, but at this time will continue to furnish ironing boards.
   f.    Do not overload the washers.  Overloading puts additional wear and tear on the machines, and does not get your clothes clean.

XXI.  GUEST RENTAL UNITS

01.    If you have a unit that you rent out and if your renters do not pay their accrued bills, you are responsible for all charges incurred by your renters. As owners of the rented unit, you are responsible for the conduct of your renters.
02.    All renters have to be approved in advance by management.
   a.   All renters must register and acknowledge receipt of and agree to abide by the park rules and regulations.
   b.   Management reserves the right to ask renters to leave upon repeated violations of any of the Park's rules and regulations.  

XXII.    RESTROOMS

01.    When taking a shower, please conserve water.  Keep showers short.  We live in the desert, water is expensive and a precious commodity.
02.    You are required to supply your own bath towels to dry after your shower.  

XXIII.    FOR SALE SIGNS

01.    For sale signs are allowed on the bulletin board only on 3 x 5 cards.
02.    One sign in the window of the unit for sale with a maximum size of 12" high and 18" wide is permitted.
03.    If you are selling your unit please advise the office.
04.    The park is not responsible to prorate any space rents between the parties.
05.    All new residents are subject to the approval of management prior to the sale being finalized.  

XXIV.    SALE AND REMOVAL OF PARK MODELS OR PERMANENT RV'S

01.    Please advise the office at least 15 days in advance if you plan to sell your permanent annual unit. 
02.    If the unit is to be removed an agreement must be signed by both parties acknowledging the responsibility for required repairs to return the site to its original condition in order for it to be ready to rent to a new tenant.
   a.   The park manager will need to know who will be responsible for the condition of the site (whether seller or buyer).
   b.   If not signed by both parties, a $500.00 deposit will be required from the sellers.  (This will be applied to the cost of readying the site for the next rental).

XXV.    DEPARTURES

01.    Please notify the office a minimum of one day prior to leaving.
02.    All bills will be finalized prior to the close of business that day, enabling you to leave any time before noon the following day.
03.    Make sure the office has current forwarding address labels for forwarding any first class mail.
   a.   If the office is not provided with address labels the forwarding of your mail will not be possible.  

XXVI.  SUBLETTING AND STORAGE

01.    Only one Recreation Vehicle is permitted to be registered to a site.  The make and model of the registered RV must be on file with the office.
02.    Subletting of a lot for temporary placement of an unregistered RV is not permitted at any time, and will be towed at the owner's expense.
03.    Annual sites that are not being occupied by the RV registered to that site may not be used for any storage purposes.
